Dallas motorcycle accident cases

Dallas motorcycle accident lawyer for injured riders

Nolan Ryan McConvilleManaging attorney · Licensed in Texas since 2016

When a driver hits a motorcycle, the rider takes the impact. Then the rider often takes the blame too. Insurers and some jurors assume a rider was speeding or weaving, even when the driver turned straight into them.

Nolan Ryan McConville is a Dallas motorcycle accident lawyer who works each case himself and answers that bias with evidence. He treats riders as clients with a case to prove, not as a risk group.

He moves quickly on the scene, the bike and the gear. The consultation is free, and there is no attorney's fee unless money is recovered.

Rider bias

Evidence answers bias against riders

Ask most drivers what happened and you'll hear "I never saw him." Adjusters often treat that as the end of the story. It isn't. A driver has a duty to look.

A motorcycle in its lane with its headlight on is there to be seen.

Quieter bias

An adjuster may lowball the claim because a rider "chose a dangerous hobby," or assume speed because of the type of bike.

Facts over assumptions

Nolan doesn't argue with assumptions. He replaces them with facts: where the bike was, how fast it was going and what the driver could see.

Why fault percentages matter

  • Texas divides fault, and every percentage point an insurer pins on you reduces what you recover.
  • An unsupported speeding claim is worth real money to them, and evidence that answers it early can change how the claim is valued.

Dallas riding risks

  • Riders face heavy freeway traffic on I-35E, I-30 and the Tollway, and surface streets full of driveways and turning cars.
  • Weekend rides toward Lake Ray Hubbard, Grapevine Lake and county roads bring loose gravel, farm equipment and drivers not looking for bikes.

Protect your claim

What riders should do after a crash

  • Keep your helmet and gear exactly as they are
  • Don't repair or sell the bike until it has been photographed and inspected
  • Save any helmet-cam, dashcam or GPS ride data
  • Get names of everyone who stopped, including other riders
  • If it is safe, photograph the road surface, debris or potholes at the scene
  • Keep receipts for custom parts, upgrades and gear
  • Keep your safety course certificate or proof of medical coverage
  • Follow your treatment plan and keep every appointment
  • Stay off social media posts about riding while your claim is open

Case preparation

What Nolan checks first

Early preparation moves evidence, the crash report, coverage and records forward, so the claim can reflect the whole injury, not only the first few weeks.

  1. 01Review step

    Hold the video

Nolan sends preservation letters to the driver and their insurer, and asks nearby businesses to hold any video before it records over.

  2. 02Review step

    Inspect the bike and gear

He arranges photos and an inspection of the bike, the other vehicle and your gear while the damage still tells the story. Nolan can discuss arrangements for preserving and inspecting the bike.

  3. 03Review step

    Review the crash report

He orders the Texas Peace Officer's Crash Report (CR-3) and reviews it closely. Rider reports sometimes repeat the driver's version without much else, and errors are easier to address early.

  4. 04Review step

    Coverage and medical records

He gathers the at-fault driver's policy limits and your own coverage, and starts collecting medical records and bills from the EMS run sheet and ER visit forward.

  5. 05Review step

    Wait for the full picture

    • Rider injuries are often serious: fractures, road rash needing skin grafts, spinal and brain injuries, often with months of care.
    • Nolan waits until the medical picture is clear to make a demand, and documents custom bikes and gear, which insurers can undervalue.

The sequence and timing depend on your case, engagement and the records available.

Many riders are still in the hospital that first week, and the evidence work doesn't wait.

How riders get hurt

Common Dallas motorcycle crashes

Left-turning drivers

A driver turns across the rider's path at an intersection or into a driveway. It is the classic rider case.

Lane changes

A driver merges into a rider in a blind spot, often on multi-lane freeways like I-635 or US-75.

Rear-end impacts

A rider stopped at a light gets hit from behind. Even a low-speed hit can throw a rider from the bike.

Road hazards

Debris, potholes and uneven construction zones can be deadly on two wheels. Government claims have short notice deadlines.

Commercial vehicles

Delivery vans and trucks with large blind spots add a company and its insurer to the case.

Passengers

A passenger on the back of a bike can have a claim of their own, separate from the rider's.

Helmet law

Helmet or no helmet, you may still have a claim

Texas lets riders 21 and older ride without a helmet if they've completed an approved safety course or carry the required medical insurance. A rider who meets those conditions is riding legally without one.

Helmets don't cause crashes

  • The defense may argue that not wearing a helmet made a head injury worse.
  • That depends on medical evidence about the specific injury, and should be tied to the injuries a helmet could have affected.

Your doctors' records

Nolan works with your treating doctors so the record shows which injuries a helmet would or wouldn't have changed.

Two separate questions

Skipping a helmet doesn't mean there's no point calling a lawyer. First: who caused the crash? Second: which injuries, if any, might a helmet have affected? Both turn on evidence.

Keep your gear

  • If you were wearing a helmet, keep it.
  • Damage to a helmet, jacket, gloves and boots can show how and where you hit, and a cracked visor or scuffed armor can help a reconstructionist place the impact.

The first question is who caused the crash.

The answer to "I didn't see him"

How Nolan rebuilds the crash

  1. 01

Lock down the scene: photos, skid and scrape marks, and video

  2. 02

Inspect the bike and the car before repairs or salvage

  3. 03

Measure sight lines and the driver's view at the point of the turn

  4. 04

Use reconstruction, when needed, to show speed and lane position

  5. 05

Find witnesses, including other riders and nearby drivers

Minimum coverage rarely covers a rider's injuries

Texas auto liability policy minimums are $30,000 per injured person, $60,000 per accident and $25,000 for property damage. Serious rider injuries can cost far more. Nolan looks for every other source: your UM/UIM coverage, a driver's employer if they were working, and any other party that shares fault. If a rider is killed, the spouse, children and parents may bring a wrongful death claim.

Your case, handled personally

5 reasons to choose Nolan Ryan

Start with facts about the rider

An assumption about motorcyclists does not explain a particular collision. Nolan reviews the road, vehicle and witness evidence when responding to disputed fault.

Preserve the bike and gear

The motorcycle, helmet, clothing and available ride records can help explain the impact. Nolan considers inspection before repairs or disposal change that evidence.

Check the report against your account

An injured rider may have left by ambulance before giving a full account. Nolan reviews the report alongside other records rather than assuming it captures everything.

Keep fault and coverage separate

Fault arguments and available insurance raise different questions. Nolan reviews each against the crash evidence and policies rather than treating one insurer's position as conclusive.

Document the effects beyond the crash

Nolan considers treatment records and the continuing effects of the injuries, so the claim is not based only on the first visit or the motorcycle's damage.

FAQs

Frequently Asked Questions

Are motorcyclists at higher risk on DFW roads?

Yes. Fort Worth’s Vision Zero Safety Action Plan found that crashes involving people walking, bicycling or riding motorcycles accounted for 4% of all crashes and 34% of fatal-or-serious-injury crashes, using 2019–2023 data.

Does Texas require motorcycle helmets?

Riders and passengers must wear a helmet unless they are 21 or older and have either completed an approved motorcycle safety course or have health insurance that covers motorcycle crash injuries (Texas Transportation Code Section 661.003). Police cannot stop a rider just to check whether that exemption applies.

How do you deal with bias against riders?

We gather the crash report, scene photos, witness statements, any video, and the damage to both vehicles. When needed, accident reconstruction can show speed, lane position and sight lines, which often answers the claim that the rider came out of nowhere.

What if the driver who hit me was uninsured?

Texas auto liability policies can have bodily-injury limits as low as $30,000 per person. Your own uninsured/underinsured motorist coverage may pay the difference, because Texas insurers must include it unless a named insured rejected it in writing.

How long do I have to file a motorcycle accident claim?

Generally two years from the crash to file a personal-injury lawsuit, subject to exceptions. Claims involving a government vehicle or road defect may have written-notice deadlines of six months or less, and immunity rules can limit whether a claim may proceed.

Can I recover if I was partly at fault?

Yes, if you were 50% or less responsible. Your recovery is reduced by your percentage of fault. Above 50%, Texas law bars recovery.

Can I recover the cost of my bike, gear and custom parts?

Usually, yes. The property claim can cover repairs or the bike's value, plus your helmet, jacket and other gear. Custom parts and upgrades are often undervalued, so keep receipts, build sheets and photos from before the crash.

Does lane splitting affect a Texas motorcycle claim?

Texas law does not allow lane splitting, and an insurer will use it to argue fault if it happened. That doesn't automatically end the claim. Under modified comparative fault, the question is how much each person contributed to the crash, and the evidence decides that.
