Dallas motorcycle accident cases

Dallas motorcycle accident lawyer for injured riders

Nolan Ryan McConvilleManaging attorney · Licensed in Texas since 2016

When a driver hits a motorcycle, the rider takes the impact. Then the rider often takes the blame too. Insurers and some jurors assume a rider was speeding or weaving, even when the driver turned straight into them.

Nolan Ryan McConville is a Dallas motorcycle accident lawyer who works each case himself and answers that bias with evidence. He treats riders as clients with a case to prove, not as a risk group. He moves quickly on the scene, the bike and the gear. The consultation is free, and there is no attorney's fee unless money is recovered.

Rider bias

Riders start with a credibility problem

Ask most drivers what happened and you'll hear the same line: "I never saw him." Adjusters often treat that as the end of the story. It isn't. A driver has a duty to look, and a motorcycle in its lane with its headlight on is there to be seen.

Bias shows up in quieter ways too. An adjuster may lowball the claim because a rider "chose a dangerous hobby," or assume speed because of the type of bike. Nolan doesn't argue with assumptions. He replaces them with facts: where the bike was, how fast it was going and what the driver could see.

Bias matters because of how Texas divides fault. Every percentage point an insurer can pin on you reduces what you recover, so an unsupported claim that you were speeding is worth real money to them. Evidence that answers it early can change how the claim is valued.

Dallas riders deal with heavy freeway traffic on I-35E, I-30 and the Tollway, and with surface streets full of driveways and turning cars. Weekend rides out toward Lake Ray Hubbard, Grapevine Lake and the county roads beyond bring their own risks: loose gravel, farm equipment and drivers who aren't looking for bikes.

How riders get hurt

Common Dallas motorcycle crashes

Left-turning drivers

A driver turns across the rider's path at an intersection or into a driveway. It is the classic rider case.

Lane changes

A driver merges into a rider in a blind spot, often on multi-lane freeways like I-635 or US-75.

Rear-end impacts

A rider stopped at a light gets hit from behind. Even a low-speed hit can throw a rider from the bike.

Road hazards

Debris, potholes and uneven construction zones can be deadly on two wheels. Government claims have short notice deadlines.

Commercial vehicles

Delivery vans and trucks with large blind spots add a company and its insurer to the case.

Passengers

A passenger on the back of a bike can have a claim of their own, separate from the rider's.

Helmet law

Helmet or no helmet, you may still have a claim

Texas lets riders 21 and older ride without a helmet if they've completed an approved safety course or carry the required medical insurance. A rider who meets those conditions is riding legally without one.

Not wearing a helmet doesn't cause a crash. But the defense may argue it made a head injury worse and should reduce your damages. That argument depends on medical evidence about the specific injury, and it does nothing to the claim for a broken leg or road rash. Nolan works with your treating doctors so the record shows which injuries a helmet would or wouldn't have changed.

Some riders assume that skipping a helmet means there's no point calling a lawyer. That isn't how it works. The first question is who caused the crash. The second is which injuries, if any, a helmet might have affected. Those are separate questions, and both turn on evidence.

If you were wearing a helmet, keep it. The damage to a helmet, jacket, gloves and boots can show how and where you hit. A cracked visor or scuffed armor can help a reconstructionist place the impact.

The answer to "I didn't see him"

How Nolan rebuilds the crash

  1. 01

Lock down the scene: photos, skid and scrape marks, and video

  2. 02

Inspect the bike and the car before repairs or salvage

  3. 03

Measure sight lines and the driver's view at the point of the turn

  4. 04

Use reconstruction, when needed, to show speed and lane position

  5. 05

Find witnesses, including other riders and nearby drivers

Protect your claim

What riders should do after a crash

  • Keep your helmet and gear exactly as they are
  • Don't repair or sell the bike until it has been photographed and inspected
  • Save any helmet-cam, dashcam or GPS ride data
  • Get names of everyone who stopped, including other riders
  • Photograph the road surface, debris or potholes at the scene
  • Keep receipts for custom parts, upgrades and gear
  • Keep your safety course certificate or proof of medical coverage
  • Follow your treatment plan and keep every appointment
  • Stay off social media posts about riding while your claim is open

Day one through seven

What Nolan does in the first week

Nolan sends preservation letters to the driver and their insurer, and asks nearby businesses to hold any video before it records over. He arranges photos and an inspection of the bike, the other vehicle and your gear while the damage still tells the story. Many riders are still in the hospital that first week, and the evidence work doesn't wait for you to get out. If you can't get to the bike, Nolan can.

He orders the Texas Peace Officer's Crash Report (CR-3) and reviews it closely. Reports in rider cases sometimes repeat the driver's version without much else, and errors are easier to address early. He gathers the at-fault driver's policy limits and your own coverage. And he starts collecting your medical records and bills from the EMS run sheet and ER visit forward.

That documentation matters because rider injuries are often serious: fractures, road rash that needs skin grafts, spinal injuries and brain injuries. Many need months of care. Nolan waits until the medical picture is clear before making a demand, so the claim reflects the whole injury, not only the first few weeks. Insurers can undervalue custom bikes and gear, so he documents the property claim with the same care.

Minimum coverage rarely covers a rider's injuries

Texas only requires 30/60/25 liability coverage, and serious rider injuries can cost far more. Nolan looks for every other source: your UM/UIM coverage, a driver's employer if they were working, and any other party that shares fault. If a rider is killed, the spouse, children and parents may bring a wrongful death claim.

FAQs

Frequently Asked Questions

Are motorcyclists at higher risk on DFW roads?

Yes. Fort Worth's Vision Zero Safety Action Plan found that motorcyclists and other vulnerable road users were involved in 4% of crashes but 34% of crashes that killed or seriously injured someone (2019 to 2023 data).

Does Texas require motorcycle helmets?

Riders and passengers must wear a helmet unless they are 21 or older and have either completed an approved motorcycle safety course or have health insurance that covers motorcycle crash injuries (Texas Transportation Code Section 661.003). Police cannot stop a rider just to check whether that exemption applies.

How do you deal with bias against riders?

We gather the crash report, scene photos, witness statements, any video, and the damage to both vehicles. When needed, accident reconstruction can show speed, lane position and sight lines, which often answers the claim that the rider came out of nowhere.

What if the driver who hit me was uninsured?

Texas only requires $30,000 per person in liability coverage. Your own uninsured/underinsured motorist coverage may pay the difference, because Texas insurers must include it unless you rejected it in writing.

How long do I have to file a motorcycle accident claim?

Generally two years from the date of the crash under Texas law. Claims involving a government vehicle or road defect have much shorter notice deadlines, often six months.

Can I recover if I was partly at fault?

Yes, if you were 50% or less responsible. Your recovery is reduced by your percentage of fault. Above 50%, Texas law bars recovery.

Can I recover the cost of my bike, gear and custom parts?

Usually, yes. The property claim can cover repairs or the bike's value, plus your helmet, jacket and other gear. Custom parts and upgrades are often undervalued, so keep receipts, build sheets and photos from before the crash.

Does lane splitting affect a Texas motorcycle claim?

Texas law does not allow lane splitting, and an insurer will use it to argue fault if it happened. That doesn't automatically end the claim. Under modified comparative fault, the question is how much each person contributed to the crash, and the evidence decides that.
