Dallas construction accident help from a trial lawyer

Nolan Ryan McConvilleManaging attorney · Licensed in Texas since 2016

Dallas never stops building. High-rises go up in Uptown and Deep Ellum, crews rebuild I-35E and I-635, and new warehouses spread along the southern edge of the county. Every one of those sites mixes several companies, heavy equipment and work at height.

When a worker is hurt, the questions start fast. Does your employer carry workers' comp? Which contractor controlled the site? Did a machine fail? Nolan sorts those questions out early, before the scene is cleaned up and the equipment goes back into service.

Who may be responsible

A construction claim is rarely about just one company

On a typical Dallas project, several companies share the work, and each has its own duties and its own insurance. Your own employer is only one piece of the picture.

Your own employer is only one piece of the picture.

The chain of companies

The owner hires a general contractor, the general contractor hires subcontractors, and those subcontractors rent cranes, lifts and scaffolding from other companies.

Nonsubscriber employers

Texas workers' compensation is optional for employers. If your employer is a nonsubscriber, you can sue it for negligence, and it loses certain common-law defenses it would otherwise have.

Employers that carry comp

If your employer carries comp, comp benefits may be your main remedy against the employer. Third-party claims may still exist against the other companies on the site.

The contracts between them

Contracts often spell out who was in charge of site safety, who had to carry insurance and who agreed to cover whom. Nolan asks for them early, because they can point to coverage no one mentioned at first.

Possible claims

Where recovery can come from after a job-site injury

Nonsubscriber employers

An employer without workers' comp can be sued for negligence, such as unsafe practices, missing fall protection or poor training.

General contractors

The company running the site often controls scheduling, safety rules and site conditions, and that control can create a duty to you.

Other subcontractors

A different trade's crew may have left an opening uncovered, dropped material or run equipment carelessly.

Equipment makers and rental companies

A lift, crane, scaffold or power tool that fails can point to the company that made, rented or maintained it.

Property owners

Owners who keep control over parts of the work or the premises may share responsibility for known hazards.

Drivers in work zones

Road crews struck by traffic may have claims against the driver and that driver's insurer.

OSHA and safety rules

How OSHA fits into a Dallas construction case

OSHA sets federal safety standards for construction, and its inspection file can become useful evidence. But an OSHA citation is not the same as a civil claim.

Federal safety standards

The standards cover fall protection, scaffolds, ladders, trenching, electrical work and crane operation. They help show what a careful company should have done.

Inspections after injuries

OSHA may open an inspection after a serious injury or a death. Its findings and citations can become useful evidence.

Penalties go elsewhere

OSHA penalties go to the government, not to you.

The inspection file

The file can contain photos, interviews and records that are hard to get any other way.

A case does not need an OSHA citation. Many valid claims involve hazards OSHA never inspected.

A real result

A $12,000,000 construction accident and wrongful death settlement

Nolan Ryan Law resolved a construction accident and wrongful death case for $12,000,000. Cases like that come from careful work early on.

Every company identified

The work starts with identifying every company involved in the project.

Evidence held on to

Holding on to the evidence early is part of the same careful work.

Prepared for a jury

Nolan prepares as though a Dallas County jury will hear the case.

Every case is different

Every case depends on its own facts, including the injuries, the insurance available and who was at fault. Past results do not guarantee a similar outcome.

From day one

What Nolan does in the first week

Nolan starts right away so the evidence, the insurance and your medical records are secured from the start.

  1. 01Right away

    Preservation letters

Nolan writes to the employer, the general contractor and any equipment or rental company, asking them to keep site video, daily logs, safety meeting records, inspection reports and the equipment itself.

  2. 02First days

    Reports and OSHA activity

He gets the incident report, any OSHA activity and, if a vehicle was involved, the crash report.

  3. 03This week

    Every insurance policy

He identifies every policy that may apply, including the general contractor's coverage and any comp policy.

  4. 04First week

    Medical records

He starts gathering your medical records from the ER forward so your injuries are documented from the start.

Protect your claim

What to do after a construction accident

  • Report the injury to your supervisor in writing and keep a copy.
  • Get medical care right away, and tell the doctor it happened at work.
  • Write down the names of your employer, the general contractor and every company on site that day.
  • Take photos of the area, the equipment and your injuries if you can.
  • Get names and numbers of coworkers who saw it happen.
  • Ask whether your employer carries workers' compensation insurance.

Deadlines can be short

Texas personal injury and wrongful death claims generally must be filed within two years. Workers' comp claims have their own, shorter reporting deadlines, and claims involving a government body usually require written notice within six months. Call early so no deadline slips by.

FAQs

Frequently Asked Questions

Can I sue my employer for a construction injury in Texas?

It depends on whether your employer carries workers' compensation. Texas employers can choose not to. If yours is a nonsubscriber, you can sue it for negligence, and it loses certain common-law defenses. If it does carry comp, comp is usually your main remedy against the employer itself.

What is a third-party claim?

It is a claim against a company other than your employer, such as the general contractor, another subcontractor, the property owner or the company that made or maintained a piece of equipment. Third-party claims may exist even when workers' comp applies, and they can include damages comp does not pay, such as pain and mental anguish.

I'm a subcontractor's employee. Does the general contractor owe me anything?

Possibly. A general contractor that controls safety rules, scheduling or how the work is done may owe duties to workers on site. The contract documents and what actually happened on the site both matter.

Does an OSHA citation prove my case?

Not by itself. OSHA standards and inspection findings can be strong evidence of what a careful company should have done, but a civil claim still has to show fault and damages. A case can also go forward without any OSHA citation.

What if I was partly at fault for the accident?

Against a third party, Texas modified comparative fault applies: you can recover if you were 50% or less at fault, and your recovery is reduced by your share. Against a nonsubscriber employer, certain fault-based defenses are not available to the employer.

What if a family member died on a construction site?

Surviving family members may have a wrongful death claim, and the estate may have a separate claim. Who can bring those claims, and against whom, depends on the facts and on the employer's comp status. These claims generally must be filed within two years.

Should I give a statement to my employer's insurer?

Report the injury to your employer, but be careful about recorded statements to any insurer, including a nonsubscriber employer's insurer or a third party's. What you say early can be used later. Ask Nolan to review any request first.

What evidence matters most after a job-site injury?

Site video, daily logs, safety meeting records, inspection reports, the equipment involved, contracts between the companies, and witness accounts. Much of it is in the hands of the companies on site, so preservation letters early on can make a real difference.
